Back to Why Islam

Law & Justice

!

Shariah is barbaric and promotes unlawful behaviour.

Islamic Response:

Qur'ān 4:135 demands justice even against oneself; Sharīʿah sets due-process standards and equal accountability (Prophet's hadith about his daughter Fāṭimah).

  • Punishments have very high evidentiary bars (e.g., four witnesses for adultery).
  • Caliph ʿUmar suspended hand-cutting during famine—showing flexibility.
  • Non-Muslims routinely won cases in Islamic courts.

Biblical / Talmudic comparison:

  1. Numbers 15:32-36: Sabbath stick-gatherer put to death by stoning.
  2. Deuteronomy 21:18-21: "rebellious son" stoned upon parents' complaint.
  3. Deuteronomy 22:20-21: bride found not a virgin is stoned at her father's door.
  4. Qur'ān contrast: Qur'ān 5:38-39 & 4:135 pair punishments with strict due-process and universal justice—Prophet ﷺ even vowed to punish his own daughter if she stole, illustrating equality before the law.

Is it fair to label Islam "barbaric" without applying the same label to Mosaic law's stoning commands?
